Drug Driving Lawyers explain that – Police need to prove that you were in charge of a motor vehicle whilst being under the influence of a relevant drug or having the presence of a relevant drug in your oral fluid (saliva), blood or your urine.

Road side drug testing is becoming more prevalent within our community since drug taking tends to also be on the increase.

Some of the relevant drugs which police test for during random drug testing include:

  • THC (Delta-9- tetrahydrocannabinol) also known as marijuana or cannabis.
  • METHYLAMPETAMINE also known as Ice or Speed.
  • METHYLENEDIOXYMETHYLAMPHETAMINE also known as ecstasy or MDMA.
  • MORPHINE.
  • COCAINE.

If any of these substances are found to be active within your salive, blood or urine then you may be at risk of being charged for driving under the influence or even the lesser offence of driving with a presence of a relevant drug in your system.

The common myth within our community is that you are safe to drive a vehicle so long as you are not under the influence of intoxication liquor or “illicit”drugs. However, more and more we are seeing horrific car accidents where the driver was actually affected by prescription drugs or medications. In particular opioid and barbiturate style prescription drugs can be just as dangerous for drivers as many of the illicit drugs that are sold on our streets. For this reason Police are beginning to become far more specific with their style of drug testing.

Drugs can be present within your saliva, blood or urine long after the effects of the drug have actually worn off, however since traces can still be found in your system then you may run the risk of being charged for drug driving.
